According to the principle of “organizational obligation”, companies in Germany have to act in compliance with the law and are required to implement corporate structures that ensure lawful acting within the individual departments, i.e. in the areas of financing, HR, administration and especially IT. The law concretizes this obligation.

From a legal perspective, an IT system must be considered a technical device that is the company’s legal responsibility. If the company discovers that the device is not under control anymore, it has to be switched off until its controllability is re-established.
